The Platform refers collectively to the Company's website, mobile applications, and all associated software and systems. By accessing or using the Platform or any of the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform or Services.

2. Definitions

• "User" refers to any individual accessing or utilizing the Platform or Services.
• "Services" include, but are not limited to: opening wallet accounts, ICT and entrepreneurship training, marketing and promoting businesses and products, and loan services.
• "Platform" is defined in Section 1 above.

3. Usage Guidelines and Account Security

• Accuracy of Information: Users must provide accurate, current, and complete information when registering for and using the Services.
• Security: Users are solely responsible for maintaining the confidentiality of their account credentials (passwords, PINs, etc.).
• Notification of Breach: Users must promptly notify the Company of any unauthorized use of their account or any suspected breach of security.
• Compliance: Users agree to comply with all applicable laws and regulations when using our Services.

4. Payment and Loan Specific Terms

a. General Fees: Users agree to pay all fees and charges associated with the Services, as specified on the Platform or communicated directly to the User.

b. Loan Services: The specific terms for Loan Services—including interest rates, repayment schedules, associated fees, penalties for late payment, and any collateral requirements—will be exclusively detailed in a separate, legally binding Loan Agreement. This Loan Agreement must be formally executed by the User before any funds are disbursed.

5. Intellectual Property Rights

All content available on the Platform is the property of SIM-BEST GLOBAL SOLUTIONS or its licensors. Users may not reproduce, distribute, or modify this content without the Company’s express prior written permission.

6. Termination

• By Company: SIM-BEST GLOBAL SOLUTIONS reserves the right to terminate or suspend a User's account or access to the Services, with or without notice, if these Terms are violated.
• By User: Users may terminate their account by formally contacting the Company through the official customer support channels.

7. Liability and Disclaimers

a. Service Provision: The Services are provided on an "as is" and "as available" basis, without warranties of any kind.

b. Limitation of Liability: SIM-BEST GLOBAL SOLUTIONS and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages (e.g., loss of profits or data) resulting from the use or inability to use the Services.

c. Maximum Liability: The Company's total cumulative liability is limited to the amount paid by the User for the specific Services in the six (6) months preceding the claim.

8. Governing Law and Dispute Resolution

a. Governing Law: These Terms are governed by and construed in accordance with the laws of Nigeria.

b. Dispute Resolution: Any disputes shall be resolved through binding arbitration administered in accordance with Nigerian law.

9. Changes to Terms

SIM-BEST GLOBAL SOLUTIONS reserves the right to modify these Terms. We will provide Users with reasonable notice (30 days) of any material changes before they become effective. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes.

By using SIM-BEST GLOBAL SOLUTIONS' Platform and Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
